Terms & Conditions and End-User License Agreement

1. Acceptance of Terms
By using SleepStory, a service provided by MXU Design, you agree to these terms and conditions. If you do not agree, please do not use the service.
2. Free Trial
The free trial period provides access to our premium content library. To create personalized stories and receive credits, users must end the trial and subscribe as a paying customer or purchase credits separately. Users can upgrade to a subscription or purchase credits at any time during the trial via the app.
3. Subscription and Payment
Post-trial, a subscription is required for continued access to premium content and story creation features. Payments are charged to your chosen method and subscriptions auto-renew unless cancelled 24 hours before the end of the current period.
4. Money Back Guarantee
A 30-day money-back guarantee is offered for the first month of subscription. The guarantee cannot be redeemed after the first month; subsequent months fall under the standard cancellation policy.
5. User Conduct
Misuse of the app or content, harassment, illegal activities, or infringement of others' rights through the app is prohibited.
6. Content Ownership and Usage
All content remains the property of MXU Design. Users are granted a license to access and listen to their content via the app. Unauthorized downloading, sharing, or circumventing access controls is forbidden and constitutes a violation of these terms.
7. No Refunds on Digital Content
Refunds are generally not available for digital content like custom sleep stories. Exceptions may be considered where content fails to meet our quality standards or due to app-related issues. However, this does not establish a legal claim for a refund.
8. Limitation of Liability
MXU Design is not liable for indirect, incidental, or consequential damages arising from the use of SleepStory.
9. Amendments to Terms
We reserve the right to modify these terms. Continued app use after changes indicates acceptance of the new terms.
10. Governing Law
These terms are governed by the laws of The Netherlands.
11(a). Age Restriction
SleepStory is not intended for, and should not be used by, individuals under the age of 13. By using this app, you represent that you are at least 13 years old. We do not knowingly collect personal information from children under 13.
11(b). Account Termination for Underage Users
We reserve the right to suspend the account of any user found to be under the age of 13 immediately. In such cases, where possible, a pro-rata refund for the remaining portion of their subscription will be issued. This action is to ensure compliance with child protection laws and to safeguard the privacy and security of all users.
